Pink & Blue Privacy Notice
This Privacy Notice applies to the Pink & Blue website, customer application, Retailer Portal, and any Pink & Blue Driver application, website, dashboard, support channel, social-media page, telephone service, promotion or related platform (collectively, the “Pink & Blue Platform”).
Pink & Blue is operated by Shaun & Deon LDA, trading as Pink & Blue (“Pink & Blue”, “we”, “us” or “our”). Pink & Blue provides technology and marketplace services that enable Customers to order goods from independent Retailers and, where available, arrange collection or delivery through independent Drivers and delivery partners. Retailers and Drivers are independent businesses or contractors unless Pink & Blue expressly states otherwise.
This Notice explains how Pink & Blue collects, uses, discloses, stores, protects and otherwise processes personal information. By using the Platform, creating an account, registering as a Retailer or Driver, placing an order, communicating with Pink & Blue or providing information, you acknowledge that you have read and understood it.
1. Applicable privacy laws
Pink & Blue operates in South Africa in accordance with applicable law, including POPIA, the Electronic Communications and Transactions Act 25 of 2002, the Consumer Protection Act 68 of 2008, and applicable South African consumer, communications, tax, payment, anti-fraud, transport, labour and recordkeeping laws. Additional legal rights and obligations apply where required.
2. Information Pink & Blue collects
Pink & Blue collects only information reasonably necessary to operate, secure, improve and lawfully administer the Platform.
2.1 Account and identity information
- Name, mobile number, email and authentication details;
- date of birth or age confirmation where required;
- profile photograph where supplied or required for verification;
- Driver and Retailer identification, licence, registration, tax, banking, insurance, vehicle or business-verification information; and
- communications and verification records.
2.2 Order, delivery and transaction information
- Delivery, collection and billing addresses, recipient details and instructions;
- order contents, Retailer selection, substitutions, history, preferences and notes;
- values, discounts, refunds, credits, payment status and transaction references;
- delivery and collection confirmation, proof or photographs and ratings; and
- support requests, complaints, chats, calls, emails and other communications.
2.3 Location information
With permission, Pink & Blue may process a Customer’s approximate or precise device location to identify Retailers, calculate delivery areas, suggest addresses and facilitate delivery. Driver location may be processed while the Driver app is active, available for orders, travelling to collection or delivering, and for a reasonable connected period. Location may also derive from addresses, IP addresses, networks, mapping services or device settings.
Driver location may be shared with the relevant Customer and Retailer for delivery status, estimated arrival, routing, safety or completion. Disabling location permission may prevent some features from working.
2.4 Device, technical and usage information
- Device, operating system, browser, app version and language;
- identifiers, IP address, network information and logs;
- pages, searches, interactions, sessions, errors and crashes;
- cookies, pixels, SDKs and similar technology; and
- security, fraud-prevention and diagnostic information.
2.5 Information from third parties
We may receive information from Retailers, Drivers, payment, identity, mapping, communication, fraud-prevention, advertising and analytics providers, authorities, regulators, insurers, referral partners, public sources and persons ordering for you.
3. How Pink & Blue uses personal information
- Create, maintain, verify and secure accounts;
- enable Customer search, orders, payments, delivery and updates;
- enable Retailer order preparation, management and fulfilment;
- enable Drivers to accept, collect, transport and deliver orders;
- verify identity, age, eligibility, licences, vehicles, businesses, banking, insurance and payments;
- process payments, refunds, credits, promotions, incentives and reconciliations;
- provide live tracking, communications, support and dispute handling;
- protect users and the public and prevent fraud, theft, abuse, chargebacks and security incidents;
- maintain quality and integrity and improve services through research, analytics and testing;
- send service, legal, safety, transactional and permitted marketing communications;
- comply with tax, accounting, legal, regulatory, audit, insurance and recordkeeping duties;
- establish or defend claims; and manage corporate transactions.
4. Lawful grounds for processing
Pink & Blue processes information to perform or enter contracts, take requested pre-contract steps, comply with law, pursue legitimate security and business interests without unfairly overriding your rights, protect safety, rights or property, or with consent where required. Consent may be withdrawn without affecting earlier lawful processing or another lawful basis.
5. Who receives your information
Pink & Blue does not sell personal information.
5.1 Retailers
Selected Retailers receive relevant names, order details, delivery requirements, notes and fulfilment information.
5.2 Drivers and delivery partners
Assigned Drivers receive relevant first name, location, necessary recipient contact details, order reference, notes and safe-delivery information. Drivers do not require full card information.
5.3 Customers and recipients
Customers may receive limited Driver information including first name, profile image, relevant vehicle information, status and live or approximate location during an active delivery.
5.4 Service providers
Selected providers may support hosting, storage, payments, mapping, geolocation, communications, verification, fraud prevention, analytics, marketing, support, legal, accounting, insurance, auditing, security and technical services, subject to appropriate obligations.
5.5 Authorities and lawful requests
Information may be disclosed to authorised bodies where required or permitted by law or reasonably necessary for safety, fraud investigation, crime prevention, enforcement or valid legal process.
5.6 Corporate transactions
Information may be shared with relevant advisers, counterparties and successors during financing, investment, merger, acquisition, restructuring, insolvency, sale or asset transfer, subject to lawful safeguards.
6. Payments
Approved third-party providers may process payment information under their own terms and notices. Pink & Blue may retain method type, transaction identifier, amount, status, refunds and anti-fraud data, but does not intentionally store full card details unless expressly stated and lawfully authorised.
7. Alcohol and restricted products
Pink & Blue, Retailers or Drivers may request identification to verify age, identity and lawful eligibility. Orders may be refused, cancelled or not delivered where requirements cannot be verified. No refund or compensation is due where refusal is legally required or results from inaccurate Customer information.
8. Cookies, analytics and similar technologies
Pink & Blue uses cookies, pixels, SDKs, logs and similar technology to operate and secure the Platform, remember preferences, process orders and payments, detect risks, understand usage, improve service, measure performance and lawfully personalise content. Blocking them may limit functionality.
9. Marketing
Pink & Blue sends necessary verification, order, receipt, delivery, security, policy and support messages. Permitted promotions may be sent by email, SMS, WhatsApp, push notification, telephone or other means. You may opt out through unsubscribe options, settings or support; essential messages continue.
10. Special personal information
Pink & Blue does not require sensitive information except where lawfully necessary and safeguarded. Do not place unnecessary sensitive information in notes, chats, instructions or support requests. Voluntarily supplied information is processed only to respond, fulfil an order, protect safety or comply with law.
11. Children
Pink & Blue is not intended for persons unable lawfully to transact or use the service. We do not knowingly process a child’s information without a lawful basis and appropriate authority. Contact us if you believe a child supplied information without permission.
12. International processing and transfers
Information is primarily processed in South Africa. Where an approved provider processes information in another country, Pink & Blue takes reasonable steps to ensure lawful transfers and appropriate contractual, organisational and technical safeguards.
13. Data retention
Information is kept only as reasonably necessary to support the Platform, accounts and orders; meet legal and recordkeeping duties; prevent fraud; investigate disputes; enforce agreements; or establish and defend claims. It is then deleted, anonymised, de-identified or securely archived unless further retention is required or permitted.
14. Security
Pink & Blue uses reasonable administrative, organisational and technical safeguards, including access controls, authentication, appropriate encryption, secure infrastructure, monitoring, confidentiality, verification, supplier controls and incident response. No digital system is completely secure. Keep credentials confidential and report suspected unauthorised use.
15. Data incidents
Pink & Blue will investigate personal-information compromises, take reasonable containment and mitigation steps, and notify affected persons and authorities where legally required.
16. Your privacy rights
Subject to law, you may request confirmation, access, correction, eligible deletion, destruction or de-identification; object to certain processing or direct marketing; withdraw consent; request recipient information where applicable; and complain to Pink & Blue or a regulator.
Submit requests through the Website, Customer App or Retailer Portal. Identity verification may be required. Rights may be limited where retention is required for fraud prevention, tax, accounting, compliance, safety or disputes.

Pink & Blue is not responsible for the privacy practices, security or content of linked third-party sites, providers, Retailers, mapping services or social platforms. Review their notices before supplying information.
19. Changes to this Privacy Notice
Pink & Blue may update this Notice for Platform, operational, technological, legal or privacy-practice changes. The current version will be published through the Platform. Continued use after it takes effect acknowledges it to the extent permitted by law.
